Announcement of the adoption of the 1st cover sheet for development plan no. 330 - Südliche Sieboldstraße - with integrated green space plan
On 28.07.2022, the City Council of the City of Erlangen adopted the 1st cover sheet for development plan no. 330 - Südliche Sieboldstraße - for the area between Sieboldstraße, Beethovenstraße, Gerstenbergstraße and Mozartstraße as a statute in accordance with Section 10 (1) of the German Building Code (BauGB).
The cover sheet was created using the accelerated procedure in accordance with Section 13a (2) BauGB.
The cover sheet with the explanatory memorandum as well as the DIN standards and other regulations mentioned in the provisions of the development plan are available for inspection by anyone at the Erlangen Office for Urban Planning and Mobility (Gebbertstraße 1, 3rd floor) during general office hours.
Upon request, information on its contents will be provided by Ms. Bödeker, Tel. 86-1333, in room no. 339.
With this announcement, the 1st cover sheet for development plan no. 330 - Südliche Sieboldstraße - comes into force in accordance with Section 10 (3) BauGB.
The statutory notices in accordance with Sections 44 (5) and 215 (2) BauGB are published following this announcement.
Further information
a) In accordance with Section 44 (5) of the German Building Code (BauGB):
If the cover sheet has caused the pecuniary disadvantages specified in Sections 39 to 42 BauGB, the person entitled to compensation may demand compensation. He can bring about the maturity of the claim by applying in writing to the party liable to pay compensation (see Section 44 (1) and (2) BauGB).
A claim for compensation expires if the claim does not fall due within three years of the end of the calendar year in which the pecuniary disadvantages specified in Sections 39 to 42 BauGB occurred.
b) In accordance with § 215 Para. 2 BauGB:
The following shall be irrelevant for the creation of this cover sheet
- a violation of the procedural and formal regulations specified in Section 214 (1) sentence 1 nos. 1 to 3 of the BauGB that is notable under Section 214 (1) sentence 1 of the BauGB,
- a violation of the provisions on the relationship between the development plan and the land use plan, which is relevant under Section 214 (2) of the BauGB, and
- any deficiencies in the balancing process pursuant to Section 214 (3) sentence 2 BauGB,
if they have not been asserted in writing to the City of Erlangen - Office for Urban Planning and Mobility - within one year of the publication of the statutes of the 1st cover sheet to development plan no. 330, stating the facts justifying the violation.
This applies accordingly if errors pursuant to Section 214 (2a) BauGB are relevant.
The planning area is located in the immediate vicinity of Werner-von-Siemens-Straße and is therefore
a location close to the city center. It was previously used entirely for commercial purposes
and has been vacant for some time. In order to enable a subsequent use of the property, the legal planning requirements for a dense development have now been created, which is characterized by commercial use on the first floor and residential use on the upper floors.
The plan area spans the scope of the previously legally binding development plan no. 330 "Gerstenbergstraße" of the city of Erlangen. This established a core area in accordance with § 7
BauNVO with 3 to 4-storey buildings and surrounding traffic areas.
The amendment to development plan no. 330 has created the necessary building rights for the development of a
of a mixed-use inner-city district as well as an appropriate density and height development.
The 1st cover sheet for development plan no. 330 - Südliche Sieboldstraße - for the area between Sieboldstraße, Beethovenstraße, Gerstenbergstraße and Mozartstraße is therefore a suitable measure to contribute to ensuring the housing needs of the population, creating and maintaining socially stable resident structures and, as an internal development, making economical use of land.
