Announcement of the adoption of the 1st cover sheet for development plan no. 412 - Häuslinger Wegäcker West -
On 13.01.2022, the City Council of the City of Erlangen adopted the 1st cover sheet for development plan no. 412 - Häuslinger Wegäcker West - for the property with plot no. 675/10 - Büchenbach district - as a statute in accordance with Section 10 (1) of the German Building Code (BauGB).
The cover sheet was created using the simplified procedure in accordance with Section 13 BauGB.
The cover sheet with the explanatory memorandum as well as the DIN standards and other regulations mentioned in the provisions of the development plan are available for inspection by anyone at the Erlangen Office for Urban Planning and Mobility (Gebbertstraße 1, 3rd floor) during general office hours.

With this announcement, the 1st cover sheet for development plan no. 412 - Häuslinger Wegäcker West - comes into force in accordance with Section 10 (3) BauGB.
The statutory notices in accordance with Sections 44 (5) and 215 (2) BauGB are published following this announcement.
a) In accordance with Section 44 (5) of the German Building Code (BauGB):
If the cover sheet has caused the pecuniary disadvantages specified in Sections 39 to 42 BauGB, the person entitled to compensation may demand compensation. He can bring about the maturity of the claim by applying in writing to the party liable to pay compensation (see Section 44 (1) and (2) BauGB).
A claim for compensation expires if the claim does not fall due within three years of the end of the calendar year in which the pecuniary disadvantages specified in Sections 39 to 42 BauGB occurred.
b) In accordance with § 215 Para. 2 BauGB:
The following shall be irrelevant for the creation of this cover sheet
- a violation of the procedural and formal regulations specified in Section 214 para. 1 sentence 1 nos. 1 to 3 of the BauGB,
- a violation of the provisions on the relationship between the development plan and the land use plan, which is relevant under Section 214 (2) of the BauGB, and
- any deficiencies in the balancing process pursuant to Section 214 (3) sentence 2 BauGB,
if they have not been asserted in writing to the City of Erlangen - Office for Urban Planning and Mobility - within one year of the publication of the statutes, stating the facts justifying the violation.

The spatial scope of this cover sheet includes plot G5 in construction area 412, which is intended for sale to a building community in accordance with the marketing concept. A building community has applied to purchase this plot. The very well-developed concept of the residential project was evaluated positively by the administration, with the result that the building community was awarded the plot and the option contract was signed.
However, the development concept required the existing development plan no. 412 to be amended in some areas. The design envisages two apartment buildings with a total of 24 to 26 residential units and a single-storey communal building with a roof terrace between the two residential buildings. The buildings are accessed via arcades. Both the access balconies and the communal building are located outside the buildable plot areas of development plan no. 412.
The aim was to enable the implementation of the building community's concept with the first cover sheet for development plan no. 412. The main features of the planning and the urban development quality remained unaffected.
The planning regulations of the legally binding development plan no. 412 remain in force insofar as they do not contradict the textual regulations of this cover sheet.
