Zoning Plan No. 472

a) Pursuant to Section 44(5) of the German Building Code (BauGB):

If the development plan has resulted in the financial losses specified in §§ 39 through 42 of the BauGB, the person entitled to compensation may demand compensation. The person may cause the claim to become due by submitting a written request for compensation to the party obligated to pay (see Section 44(1) and (2) of the BauGB).

A claim for compensation expires if the claim is not made due within three years after the end of the calendar year in which the financial losses specified in §§ 39 through 42 BauGB occurred.

b) Pursuant to § 215(2) of the BauGB:

Irrespective of whether this zoning plan was adopted,

a violation of the procedural and formal requirements specified in § 214(1), sentence 1, nos. 1 through 3 of the BauGB that is deemed material under those provisions,

a violation, significant under § 214(2) of the BauGB, of the provisions governing the relationship between the development plan and the land-use plan, and

significant defects in the balancing process pursuant to Section 214(3), second sentence, of the BauGB,

unless they have been asserted in writing to the City of Erlangen—Office for Urban Planning and Mobility—within one year of the publication of the zoning plan, setting forth the facts justifying the violation.

The planned pedestrian and bike path is an important connection between Erlangen and Haundorf and Herzogenaurach, particularly the Herzo Base residential and commercial area.

As part of the expansion of the A3 interstate to six lanes in the future, the underpass is to be widened during the reconstruction of the interstate bridge between Haundorf and Häusling, thereby creating space for the new pedestrian and bike path connection.

The development plan is intended to enable the completion of the pedestrian and bicycle path from the end of the A3 expansion to Häusling.
