Enforcement of the Federal Water Act (WHG) and the Bavarian Water Act (BayWG); Authorization procedure for the extraction of groundwater by Erlanger Stadtwerke AG, Äußere Brucker Straße 33, 91052 Erlangen, from the new well SF 14 (plot no. 2975/0, Erlangen district) in the southern section of the western water protection area for the public water supply of the city of Erlangen

Erlanger Stadtwerke AG has applied for a permit (§§ 8 para. 1, 10 para. 1 WHG) for the extraction of groundwater from the new well SF 14 (plot no. 2975/0, Erlangen district).

An increase in the permit issued by the City of Erlangen on October 14, 1999, Ref.: I/R/314/Ros. (with amendment notice dated 22.03.2018, ref.: I/31/BB008 and amendment notice dated 19.06.2020, ref.: VII/31/KK021) of 1,500,000 m³ of groundwater per year or 83 liters per second from the southern catchment of the water protection area in the city of Erlangen and in the municipalities of Möhrendorf and Bubenreuth was not applied for.

So far, wells SF 02/04/06/07/08/09/10/11/12/13 have been operated there to extract the approved withdrawal volumes. Well SF 02 was dismantled in 2025 and replaced by well SF 14, which is now to be put into operation in order to ensure consistent drinking water quality.

The production capacity approved on October 14, 1999 is to be distributed among all remaining wells, including well SF 14. The following maximum groundwater volumes are to be extracted from well SF 14:

  • 11 liters per second (8.3 liters per second in continuous operation)
  • 950 m³ per day
  • 261,750 m³ per year.

The extraction of groundwater constitutes a use of water within the meaning of
§ 9 para. 1 no. 5 WHG and therefore requires a permit or authorization
(§ 8 WHG).

The project is authorized in accordance with Art. 69 Sentence 2 BayWG in conjunction with. Art. 73 para. 5 of the Bavarian Administrative Procedure Act (BayVwVfG).

The plans are available from Friday, 13.02.2026 to Thursday, 12.03.2026

  • at the City of Erlangen, Schuhstraße 40, 91052 Erlangen, Office for Environmental Protection and Energy Issues, 4th floor, room 408 during the opening hours of the Office for Environmental Protection and Energy Issues (Monday to Thursday from 9:30 am to 3:00 pm and Friday from 9:30 am to 12:00 pm)
  • at the municipality of Bubenreuth, Birkenallee 51, 91088 Bubenreuth, Planning Office, Room 4 during the opening hours from Monday to Friday from 8:00 a.m. to 12:00 p.m. and additionally on Thursday from 2:00 p.m. to 5:00 p.m.
  • at the municipality of Möhrendorf, Hauptstraße 16, 91096 Möhrendorf, building authority, room 18

for inspection (Art. 69 sentence 2 BayWG, Art. 73 para. 3 sentence 1 BayVwVfG).

The application documents will also be posted on the website of the City of Erlangen at https://erlangen.de/de/aktuelles/auslegungsunterlagen-fuer-trinkwasserbrunnen-sf14 from 13.02.2026 in accordance with Art. 27a of the Bavarian Administrative Procedure Act (BayVwVfG).

It should be noted that anyone whose interests are affected by the project may raise objections to it in writing or for the record by no later than 2 weeks after the end of the public display period, i.e. by Thursday, 26.03.2026 (Art. 69 sentence 2 BayWG in conjunction with Art. 73 para. 4 sentence 1 BayVwVfG). This can be done at any of the issuing authorities (Möhrendorf municipality, Bubenreuth municipality and Erlangen city council).

Associations that are entitled to appeal against the decision on this application on the basis of recognition under other legal provisions may submit comments to the municipality of Möhrendorf, the municipality of Bubenreuth and the city of Erlangen by Thursday, 26.03.2026 at the latest.

In the case of objections signed by more than 50 persons on signature lists or submitted in the form of duplicated identical texts, one signatory must be designated as the representative of the other signatories for the procedure with their name, profession and address, unless they have been appointed by them as an authorized representative. Representatives can only be natural persons. This information must be clearly visible on each page bearing a signature (see Art. 17 Para. 2 BayVwVfG).

Objections to the plan (application) and comments from associations submitted in good time will be dealt with at a hearing, which will be announced in the usual manner. Those who have raised objections or their representatives or authorized agents will be notified separately of the hearing. If more than 50 such notifications are to be made, those who have raised objections may be notified of the hearing by public announcement. If a party fails to attend the hearing, the hearing may also be held without that party.
