Announcement of the result in accordance with Section 5 (2) sentence 1 UVPG

Enforcement of the Federal Water Act (WHG), the Bavarian Water Act (BayWG) and the Environmental Impact Assessment Act (UVPG);
Examination of the obligation to carry out an environmental impact assessment for the removal of surface water from the Main-Danube Canal by the Hüttendorf Main-Danube Canal Water Association at the level of property no. 382, Hüttendorf district
The Hüttendorf Main-Danube Canal Water Association has applied to the City of Erlangen for a water law permit (Section 8 (1) WHG) to withdraw 300,000 m³ of surface water per year for the irrigation of agricultural land in its association area. The abstraction takes place at the bridge at the level of property no. 382, Hüttendorf district.
The withdrawal of surface water to the extent applied for is subject to the general preliminary assessment obligation pursuant to Section 7 (1) sentence 1 UVPG in conjunction with No. 13.5.1 of Annex 1 to the UVPG. The City of Erlangen has examined whether a formal environmental impact assessment must be carried out in the water permit procedure. The authorities whose environmental responsibilities are affected by the project were involved in the procedure.
As a result, it was determined that the project is not expected to have any significant adverse effects on the environment if it is implemented in accordance with the application documents and in compliance with the statutory provisions and the ancillary provisions to be stipulated.
The result of the preliminary assessment is published in accordance with Section 5 (2) sentence 1 UVPG. The determination is not independently contestable.
Result:
The preliminary assessment, taking into account the comments submitted by the authorities involved, revealed that, in the opinion of the water rights authority, a formal environmental impact assessment is not required for the project based on a rough assessment taking into account the criteria listed in Annex 3 to the UVPG. not as the project is not expected to have any significant adverse environmental impacts that would have to be taken into account in the approval decision in accordance with Section 25 (2) UVPG (Section 7 (1) sentence 3 UVPG). In particular, the use of the natural resource of water is within the scope of the existing supply of the non-natural federal waterway, the Main-Danube Canal, which is expected to have only a minor impact. This is also underpinned by the experience of 20 years of abstraction, the permit for which was renewed by halving the previous maximum annual abstraction volume.
