Announcement of the adoption of the 2nd cover sheet for development plan no. E 232 - Südlicher Ahornweg - with integrated green space plan and the 11th correction of the land use plan with integrated landscape plan 2003
On 29.09.2022, the City Council of the City of Erlangen adopted the 2nd cover sheet for development plan no. E 232 - Südlicher Ahornweg - for the site of the former tennis facility on Ahornweg and the southern access road to the building plot, plot no. 1065 and part of plot no. 190, both in the Eltersdorf district, as a statute in accordance with Section 10 (1) of the German Building Code (BauGB).
The cover sheet was drawn up using the accelerated procedure in accordance with Section 13a (2) BauGB.
The 2003 land use plan with integrated landscape plan was adapted to the above-mentioned cover sheet by way of correction in accordance with Section 13a (2) No. 2 BauGB.
The cover sheet with reasons, the DIN standards mentioned in the provisions of the development plan and other regulations as well as the 11th amendment to the land use plan are available for inspection by anyone at the Erlangen Office for Urban Planning and Mobility (Gebbertstraße 1, 3rd floor) during general office hours.
Information on the contents of the cover sheet is available on request in room no. 309 from Ms. Körner, tel. 86-1340, and on the correction of the land use plan in room no. 338 from Ms. Kutzberger, tel. 86-1389.
With this announcement, the 2nd cover sheet for development plan no. E 232 - Südlicher Ahornweg - comes into force in accordance with Section 10 (3) BauGB. At the same time, the 11th correction of the land use plan with integrated landscape plan 2003 for the sub-area - Südlicher Ahornweg - becomes effective in accordance with Section 6 (5) sentence 2 BauGB.
The statutory notices in accordance with Sections 44 (5) and 215 (2) BauGB are published following this announcement.
a) In accordance with Section 44 (5) of the German Building Code (BauGB):
If the cover sheet has caused the pecuniary disadvantages specified in Sections 39 to 42 BauGB, the person entitled to compensation may demand compensation. He can bring about the due date of the claim by applying in writing to the party liable to pay compensation (see Section 44 (1) and (2) BauGB).
A claim for compensation expires if the claim does not fall due within three years of the end of the calendar year in which the pecuniary disadvantages specified in Sections 39 to 42 BauGB occurred.
b) In accordance with § 215 Para. 2 BauGB:
The following shall be irrelevant for the creation of this cover sheet
- a violation of the procedural and formal regulations specified in Section 214 (1) sentence 1 nos. 1 to 3 of the BauGB that is notable under Section 214 (1) sentence 1 of the BauGB,
- a violation of the provisions on the relationship between the development plan and the land use plan, which is relevant under Section 214 (2) of the BauGB, and
- any deficiencies in the balancing process pursuant to Section 214 (3) sentence 2 BauGB,
if they have not been asserted in writing to the City of Erlangen - Office for Urban Planning and Mobility - within one year of the publication of the statutes of the 2nd cover sheet to the development plan no. E 232 and the 11th correction of the land use plan, stating the facts justifying the violation.
This applies accordingly if errors pursuant to Section 214 (2a) BauGB are relevant.

The plot of land located northwest of the Fürth/Erlangen freeway junction, parcel no. 1065, Eltersdorf district, was formerly used as a tennis facility with outdoor courts and an indoor tennis hall. However, this use was abandoned some time ago and the property was acquired by a developer. In the course of the subsequent use of the property, it is now intended to adapt the building planning law to current requirements, also with regard to the creation of living space.
The aim of the planning is the construction of an apartment building and dense groups of houses, which are to be realized in the form of three staggered structures of different heights with flat roofs. A small neighborhood square is to be created in the south for future residents.
The planning area is located within the scope of the legally binding development plan no. E 232 "Weidenweg" of the city of Erlangen. This plan defines a mixed-use area on the above-mentioned property in accordance with Section 6 BauNVO with single-storey buildings and a road traffic area with public parking spaces at the southern access to the property.
The amendment to development plan no. E 232 has created the right to build residential space at an appropriate density and height.
Against this background, the 2nd cover sheet for development plan no. E 232 - Südlicher Ahornweg - for the site of the former tennis facility is a suitable measure to help meet the housing needs of the population. Inner development ensures that land is used sparingly.
