Preservation statutes (milieu protection) in Erlangen

An important instrument for protecting existing apartments from conversion and luxury renovations is the conservation statute in accordance with Section 172 of the German Building Code (BauGB).
Conservation statutes in accordance with Section 172 of the German Building Code (BauGB) are an important instrument for protecting existing apartments from conversion and luxury renovations. Cities and municipalities can place certain areas under special protection by means of conservation statutes.
The preservation statute does not serve to protect individual tenants, but rather has the task of preserving the established milieu if this is necessary for urban development reasons (= milieu protection).
The city of Erlangen currently has two conservation statutes in accordance with Section 172 (1) sentence 1 no. 2 (4) BauGB. The statutes cover the areas "Jaminstraße" and "östliche Hertleinstraße". The scope of the areas can be found in the corresponding statutes.
In these areas, planned modernizations, changes and structural measures must also be approved.

There are two options for approval:
- If the project requires planning permission, the application must be submitted to the building authority together with the planning application. In the course of processing the application, the building authority will obtain an opinion from the body responsible for the conservation statutes
- If the project does not require a building permit, the application must be submitted directly to the office responsible for the conservation statutes.
The Social Welfare Office, Housing Department, is responsible for enforcing the conservation statutes.
