Free transportation to school
Pupil transportation in Bavaria is regulated by the law on free transportation to school (Schulwegkostenfreiheitsgesetz - SchKfrG) and the ordinance on school transportation (Schülerbeförderungsverordnung - SchBefV), as amended.
These apply to pupils at
- public elementary school, secondary schools and special schools
- public or state-recognized secondary schools, grammar schools, vocational schools (excluding part-time vocational schools), two-tier business schools and three-, four- or five-tier business schools up to and including year 10
as well as at vocational schools with full-time instruction (basic vocational school year or vocational preparation year or vocational integration class) - public or state-recognized secondary schools, grammar schools, vocational schools,
Vocational schools (excluding part-time vocational schools), business schools, technical colleges and vocational colleges without limitation to certain grades for pupils who are dependent on transportation due to a permanent disability.
The obligation to provide transportation exists "to compulsory and compulsory elective classes at the nearest school", which is
- the compulsory school (= Sprengelschule), no guest pupils
- the school to which the pupils are assigned (by assignment of the state education authority or by the secondary school coordinator)
- the school of the chosen type of school, training and subject area that can be reached with the least amount of transportation (costs/month for a monthly student ticket).
What requirements must be met?
The transportation obligation exists
if the shortest reasonable walking distance from home to the nearest school is more than two kilometers for students in grade 1 with 4 or more than three kilometers from grade 5 (the distance measured is the distance covered on foot, not by public transport or bicycle etc.) or
if a permanent disability of the pupil is proven (severely disabled person's pass, in exceptional cases an official medical certificate) or
if the route to school is recognized as particularly dangerous or particularly difficult (e.g. if there are no sidewalks or other traffic-safe facilities or if remote and lonely paths are away from residential areas).
Pupils in year 11 and above at public and state-recognized private grammar schools and vocational schools (excluding part-time vocational schools), technical colleges and vocational colleges are entitled to reimbursement of travel costs if the costs of the necessary transport exceed a limit of currently € 320.00 per school year and pupil or € 490.00 per school year and family (subject to legal changes). The application for reimbursement of travel costs must be submitted to the School Administration Office of the City of Erlangen by October 31 at the latest for the previous school year (statutory deadline). The same applies to part-time vocational students.
The costs will be reimbursed without deduction of the personal contribution or free school transportation will be granted if
- the legal guardians receive child benefit for three or more children in accordance with the Federal Child Benefit Act or
- the legal guardians or the pupils themselves are entitled to assistance with living expenses in accordance with the Twelfth Book of the German Social Code (SGB XII) or unemployment benefit II or social benefit in accordance with the Second Book of the German Social Code (SGB II).
Proof of this must be submitted in August before the start of the school year. If the application is submitted during the current school year, proof from the month before the application is submitted is required. If there is a reason for exemption (child benefit or social assistance), the application for free school transport can also be submitted at the beginning of the school year. A subsequent application for reimbursement of travel costs is then no longer necessary. However, this only applies to full-time education. Only the original travel receipts or personal invoices or proof of payment are eligible for reimbursement. Important: The requirements for free travel to school must also be met here (more than three kilometers to school, attendance at the nearest school)!
Application for free transportation to school
The application for free travel to school must be submitted via the VGN school portal smaxi at https://smaxi.vgn.de.
The digital application must be accompanied by any necessary proof (e.g. proof of child benefit/account statement with transfer of child benefit, copy of social welfare notice, copy of severely disabled person's ID, etc.). The application in the VGN school portal can be viewed by the schools and the school administration office and can be processed after the application has been sent. Please note that free school transport can only be approved on application. This means that tokens can only be issued from the date of application.
The tokens are generally issued to pupils in Erlangen schools after the summer vacation until the end of September. If you attend a school outside Erlangen, you must collect the tokens in person from the Erlangen School Administration Office. Pupils of legal age or their legal guardians will be contacted for this purpose.
The City of Erlangen fulfills the obligation to provide free school transport in cooperation with local public transport companies. Other means of transport (special school bus, private vehicle, cab or rental car) can only be recognized if this is absolutely necessary or more economical. Costs for the use of a car will only be reimbursed if the use of the car has been approved in advance. The application for this must be submitted to the School Administration Office of the City of Erlangen at the beginning of the school year.
Relocation / change of school
In order to check whether there is still an entitlement to free transportation, a new application must be submitted to the responsible authority each time there is a personal change such as a change of school and/or relocation. If there is no longer an entitlement, the tokens must be returned. Otherwise these costs will be invoiced. The notification of the above-mentioned changes can easily be made via the VGN school portal.
No replacement will be provided if the tokens are lost!
