PlaFe Flood Protection Project in Schwabach: Invitation to a Public Hearing

Enforcement of the Water Resources Act (WHG) and the Bavarian Water Act (BayWG); Invitation to a public hearing as part of the planning approval process for the construction and operation of a technical flood protection system on the Schwabach River between river km 0.19 and river km 0.86 and on the Mühlbach Stream between river km 0 and river km 0.25, all within the municipal district of 91054 Erlangen (primarily in the area of Jahnstraße, Haagstraße, as well as Bayreuther Straße and Essenbacher Straße) and design measures (improvements) in the riverbed and along the banks of the Schwabach, as well as a water law proceeding for the discharge of stormwater, seepage water, and pressure water from the flood protection facilities into the Schwabach at river section No. 1518 (river km 0.44) and Fl. No. 1344 (river km 0.51), both in the municipal district 91054 Erlangen.

pursuant to Art. 73, para. 6, sentence 2 of the Bavarian Administrative Procedure Act (BayVwVfG)
The City of Erlangen is holding a public hearing as part of the above-mentioned proceeding pursuant to Article 73(6) of the Bavarian Administrative Procedure Act (BayVwVfG) in conjunction with Article 69(2), sentence 4, of the Bavarian Water Act (BayWG). The City of Erlangen will discuss the objections filed against the plan within the prescribed time limit, the comments submitted in a timely manner by associations within the meaning of Article 73(4), sentence 5 of the Bavarian Administrative Procedure Act (BayVwVfG), as well as the comments from the authorities regarding the plan, will be discussed by the City of Erlangen with the Free State of Bavaria, represented by the Nuremberg Water Management Office as the project sponsor, the authorities, the affected parties, and those who have filed objections or submitted comments.
The public hearing will take place on
Thursday, February 4, 2027, starting at 9:00 a.m.
in the Council Chamber, 1st floor of Erlangen City Hall
(Rathausplatz 1, 91052 Erlangen).
Admission begins at 8:30 a.m.
If necessary, the meeting will continue on Friday, February 5, 2027, starting at 9:00 a.m. The chairperson will decide whether to continue the meeting at the end of the first day of proceedings.
The public hearing scheduled in the aforementioned proceeding, as announced in the notices dated June 1, 2026, and July 22, 2026, will take place on
Tuesday, November 3, 2026, from 9:00 a.m. to 5:00 p.m.

The discussion session is part of the public hearing process and serves to discuss the objections and comments submitted in a timely manner with the authorities, the affected parties, and other objectors and commenters, to clarify unclear or general objections, to provide those affected with more detailed information about the planned measures, and, where possible, to reach an agreement.
The chairperson will open the meeting and set the end time for the discussion session, subject to subsequent changes at the chairperson’s discretion.
Agenda:
The public hearing is structured as follows, though the chair may make changes. It is planned to discuss the comments and objections in approximately the following order:
- February 4, 2027, morning: Discussion of the objections and comments from public interest entities and associations pursuant to Art. 73(4), sentence 5, of the Bavarian Administrative Procedure Act (BayVwVfG) (in particular environmental organizations)
- February 4, 2027, afternoon: Discussion of the objections
Please note the following:
- The hearing is not open to the public.
- In addition to the project proponent, the authorities, those affected, and those who have filed objections or submitted comments in a timely manner areeligible to participate. There is no right to have comments or objections discussed. To verify eligibility to participate, we ask that you present an official photo ID and/or employee ID card at the entrance without being asked.
- Participation in the meeting is voluntary. If a party fails to attend, the discussion may proceed without them. In this case, the objections and comments submitted remain valid.
- If you wish to be represented by an authorized representative at the hearing, you must present a corresponding written power of attorney.
- The hearing proceedings conclude upon the conclusion of the discussion session.
- Any expenses incurred as a result of attending the hearing (including those for authorized representatives) cannot be reimbursed.
- Those who have raised objections, or their representatives or authorized agents, representatives of authorities, and associations pursuant to Art. 73(4), sentence 5, of the Bavarian Administrative Procedure Act (BayVwVfG) that have submitted a statement in the proceedings will be notified separately of the public hearing as well as of the cancellation of the public hearing on November 3, 2026. The planning approval authority reserves the right, in individual cases, to forward the project proponents’ respective responses to objections or statements.
- To facilitate the preparation of the legally required minutes (pursuant to Art. 73(6) of the Bavarian Administrative Procedure Act (BayVwVfG)), the planning approval authority reserves the right to record the public hearing, in whole or in part, on audio tape (Legal basis: Art. 6(1)(e) of the General Data Protection Regulation (GDPR)). The audio recording, which will be used exclusively for the purpose of creating the minutes and not for further publication, will be deleted immediately after the minutes have been prepared. No private audio, photo, or video recordings may be made by parties to the proceedings or by the public. Unauthorized recordings may result in legal action.
