Announcement of the adoption of development plan no. 469 - Häusling Nord - with integrated green space plan
and the 10th correction of the land use plan with integrated landscape plan 2003
On 17.11.2021, the Erlangen City Council adopted development plan no. 469 - Häusling Nord - for parcel no. 501 and parts of parcel nos. 466, 499, 500, 509, 545, 557 in the district of Kosbach as a statute in accordance with Section 10 (1) of the German Building Code (BauGB).
The development plan was drawn up in accordance with Section 13b BauGB using the accelerated procedure pursuant to Section 13a (2) BauGB.
The land use plan with integrated landscape plan 2003 was drawn up in accordance with § 13b in conjunction with § 13a para. V. m. § 13a para. 2 no. 2 BauGB by way of correction to the aforementioned development plan.
The development plan with explanatory memorandum, the DIN standards mentioned in the provisions of the development plan and other regulations as well as the 10th correction of the land use plan are available for inspection by anyone at the Erlangen Office for Urban Planning and Mobility (Gebbertstraße 1, 3rd floor) during general office hours.
On request, information on the content of the development plan can be obtained by prior appointment by telephone in room no. 305 from Mr. Fritsch, tel. 86-1348, and on the correction of the land use plan in room no. 338 from Ms. Kutzberger, tel. 86-1330.
With this announcement, development plan no. 469 - Häusling Nord - comes into force in accordance with Section 10 (3) BauGB. At the same time, the 10th correction of the land use plan with integrated landscape plan 2003 for the sub-area - Häusling Nord - becomes effective in accordance with Section 6 (5) sentence 2 BauGB.
The statutory notices in accordance with §§ 44 Para. 5 and 215 Para. 2 BauGB are published following this announcement.
a) In accordance with Section 44 (5) of the German Building Code (BauGB):
If the property disadvantages specified in Sections 39 to 42 BauGB have occurred as a result of the development plan, the person entitled to compensation may demand compensation. He can bring about the maturity of the claim by applying in writing to the party liable to pay compensation (see Section 44 (1) and (2) BauGB).
A claim for compensation expires if the claim does not fall due within three years of the end of the calendar year in which the pecuniary disadvantages specified in Sections 39 to 42 BauGB occurred.
b) In accordance with § 215 Para. 2 BauGB:
The following shall be disregarded in the creation of this development plan
- a violation of the procedural and formal regulations specified in Section 214 para. 1 sentence 1 nos. 1 to 3 of the German Building Code (BauGB),
- a violation of the provisions on the relationship between the development plan and the land use plan, which is relevant under Section 214 (2) of the BauGB, and
- any deficiencies in the balancing process pursuant to Section 214 (3) sentence 2 BauGB,
if they have not been asserted in writing to the City of Erlangen - Office for Urban Planning and Mobility - within one year of the publication of the statutes of development plan no. 469 and the 10th correction of the land use plan, stating the facts justifying the violation.
This applies accordingly if errors pursuant to Section 214 (2a) BauGB are relevant.

The property located on the northern edge of Häusling is currently used for agricultural purposes and is to be converted into residential land with a view to creating living space. The planning area ensures the expansion of the existing building areas to the north.
In order to develop a compatible concept, a development proposal was drawn up in consultation with the developer, which forms the basis of the development plan.
With the creation of development plan no. 469 - Häusling Nord - the legal planning basis was created for a development with semi-detached and detached houses. A green area on the edge of the village will close off the plan area to the north in future. The area will be connected to Haundorfer Strasse in the west and Reitersbergstrasse in the east. There are already existing residential buildings to the south of the planning area, so that the new plans will fit into the existing structure.
On the one hand, parcel number 545, district of Kosbach, was allocated to the area covered by the development plan so that a rainwater retention basin can be created there, in which the surface runoff from the new development area can be collected and then discharged into the Bimbach to the south without causing any damage. On the other hand, part of parcel number 557, district of Kosbach, was allocated to the area of application as an external compensation area for CEF (Continuous Ecological Functionality) measures.
