Ordinance on medium-sized combustion plants - 44th BImSchV

On June 20, 2019, the Ordinance on Medium-Sized Combustion, Gas Turbine and Internal Combustion Engine Plants (44th BImSchV) came into force. The new ordinance transposes EU Directive 2015/2193 (MCP Directive) into national law.

It applies to medium-sized combustion, gas turbine and internal combustion engine plants with a rated thermal input of 1 to 50 MW, which were previously regulated in the TA Luft and the 1st BImSchV. The exact scope of application is regulated in § 1 of the 44th BImSchV .

The ordinance provides for emission limit values for the air pollutants sulphur dioxide (SO2), nitrogen oxides (NOx) and total dust, which apply directly or from 2025 or 2030. In addition, requirements are set for the registration of installations that do not require a permit and the monitoring of emissions from the installations as well as reporting to the European Commission for the years 2021, 2026 and 2031 on the development of emissions in the regulated installations.

Obligation to notify

In accordance with Section 6 (1) of the 44th BImSchV, new combustion plants must be reported to the City of Erlangen's immission control department before commissioning. Existing plants must be notified by 01.12.2023. The notification must contain the information specified in

Annex 1 to § 6 of the 44th BImSchV

and can be submitted online, by email or in writing.

Register

As the competent authority pursuant to § 36 of the 44th BImSchV, the immission control authority must keep and publish a register of installations containing information on every combustion installation to be registered pursuant to § 6 of the 44th BImSchV.
