Anyone who drills a hole, builds a well, or performs other work that penetrates the ground to such a depth that it could affect the groundwater must report this to the responsible district administrative authority.

The obligation to report generally rests with the project owner. If the project owner hires a drilling company, that company must inform the district administrative authority.

The notification may be submitted in writing or, depending on the district administrative authority, electronically.

The competent district administrative authority reviews the notification, with the Water Management Office participating as necessary. The review assesses whether there are any restrictions on excavation at the proposed site or whether the procedure must be discontinued.

Furthermore, as part of this review, a decision is made as to whether additional procedures beyond the notification are required, such as a water rights permitting process.

The relevant authority will notify the applicant of the result in writing.

In addition to the notification required under the Water Resources Act/Bavarian Water Act to the District Administrative Authority, all groundwater extractions (wells, boreholes, etc.) must also be reported to the State Office for the Environment (LfU).

The notification to the LfU must be submitted at least two weeks before the start of the investigation. The LfU offers an online application for digital notification (see “Further Links” and “Related Services”). Upon completion of the work, all data collected must be submitted to the LfU.

The notification must be submitted to the district administrative authority at least 4 weeks before work begins.
