Family Law Certification - Child Support Obligation

The person obligated to pay child support may, by means of a unilateral declaration of intent, confirm the substance of the child support obligation owed to a descendant. This formal acknowledgment of the child support obligation strengthens the legal position of the child entitled to support in child support proceedings.
In addition, the declaration of obligation, in its notarized form, has another important significance: If the declaration specifies a specific amount for support (either as a fixed sum or as a percentage of the applicable statutory minimum support), it can be converted into a support order by subjecting the support obligor to immediate enforcement. This may, under certain circumstances, make it possible to avoid maintenance proceedings before the local court—family court.
The notary public at any youth welfare office throughout Germany is responsible for the public notarization of the obligation to fulfill a descendant’s maintenance claims. The jurisdiction of notaries, other notary public officials, or other authorities for public notarizations remains unaffected by this.
A person with limited legal capacity cannot assume a maintenance obligation on his or her own legal behalf. To do so, he or she requires the consent of his or her legal representative.
When performing the public notarization, the notary does not verify whether the maintenance amount agreed to by the party assuming the obligation is reasonable.
Certifications issued by the certifying officer at the Youth Welfare Office are free of charge.
