Fishing lease; filing and review

Fishing leases must be concluded for at least ten years. The number of leaseholders may not exceed three persons. The fishing water may not be divided into several sections for leasing purposes. Such a fragmentation of the fishing rights would run counter to sustainable management in line with the conservation objective.

The lessor's main obligation is to allow the lessee to exercise the fishing rights for the duration of the lease. This includes, in particular, fishing as well as the right of appropriation of the fish caught and fish management. The lessee is only authorized to issue permits for fishing in the water concerned with the express consent of the lessor. The lessor may also reserve the right to issue permits.

The lessee is obliged to pay the rent and to exercise the fishing right properly and in accordance with the statutory conservation objectives. Only those in possession of a valid fishing license may be leaseholders.

The lease regularly ends at the end of the agreed lease term.

The lease agreement must be concluded in writing and signed by both parties in their own hand. A fishing lease that does not comply with these formal requirements is null and void, i.e. ineffective from the outset. The lessor must submit the contract to the district administrative authority within eight days of concluding it; the fishing expertise assessment is the responsibility of the district fisheries advisory service.

A lessor can only be a person who is authorized to exercise their fishing rights in person. This requirement may not be met in the case of joint fishing rights or if the fishing right is included in a joint fishing operation; in this case, the separate leasing of the fishing right is excluded.

Only those who hold a valid fishing license may be leaseholders.
