Pharmacy; Application for an Operating License

Anyone who wishes to operate a pharmacy—whether as an owner, lessee, or manager—must obtain a license in accordance with the Pharmacy Act. This license must be applied for at the locally competent district administrative authority (district office or independent city).

The pharmacy may not open until the competent authority has conducted an inspection and certified that the pharmacy meets the legal requirements.

The license may also be suspended or revoked by the competent authority under certain conditions.

You may submit your application for a license to operate a pharmacy in writing as an informal application. Please send it, along with the required documents (see“Required Documents”), to the contact address listed below.

• Application for a Pharmacy Operating License
  including details on when you intend to operate which pharmacy and in what capacity (owner, leaseholder, etc.)
• Certificates
  Medical license (original or certified copy); doctoral degree certificate (original or certified copy), if applicable
• Medical Certificate
  This must expressly state that you are physically and mentally fit to operate a pharmacy and that you do not suffer from any addictions.
• Excerpt from the Central Business Register
• Official Certificate of Good Conduct
• Identification card or passport
• Confirmation from the State Board of Pharmacy regarding the activities reported to it and a statement regarding the individual’s reliability
• Affidavit
  By doing so, you certify that you have not entered into any agreement that violates § 8, sentence 2, Section 9(1), Section 10, or Section 11 of the ApoG, and that you have submitted the purchase or lease agreement for the pharmacy, as well as, upon request by the authorities, any other agreements related to the establishment and operation of the pharmacy. It is best to submit the affidavit in person to the district administrative authority.
• Statement Regarding the Operation of Other Pharmacies
  You must provide written notice stating whether, and if so, in which location, you operate one or more pharmacies in another Member State of the European Union, in another State party to the Agreement on the European Economic Area, or in a State party to which Germany and the European Union have contractually granted a corresponding legal entitlement, operate one or more pharmacies
• Resume
  including information on education and previous professional experience, in particular documentation of pharmaceutical practice during the two years prior to the application
• Plans
  
  • Official site plan of the property with precise location details (required only for the construction of a new pharmacy)
  • Architectural drawings of the planned operational spaces
  • The intended use and the respective size (sq m) of the rooms must be specified. However, this is generally only required for newly constructed pharmacies
  • List of rooms (original or certified copy)
• Proof of actual control over the pharmacy (original or certified copy)
  
  • As the owner of the pharmacy: purchase agreement, gift deed, will
  • As a lessee of the pharmacy: lease agreement
  • Declaration by the lessor: The lessor must submit a written declaration to the district administrative authority stating the reason for the lease (§ 9(1)(1) ApoG)
  • As the administrator of the pharmacy: administration agreement
