Business registration; business re-registration

A business re-registration may be necessary if you

• relocate the registered office of your business within the municipality;
• change the subject of your business;
• change your name or, in the case of legal entities (e.g. GmbH, UG ), the name of the company or
• extend the subject of your business to goods or services that are not customary for businesses of the registered type.

Certain trades are not subject to licensing, but are subject to special official monitoring (trades requiring monitoring in accordance with § 38 GewO). The following trades are affected:

1. Buying and selling by businesses specializing in the trade of second-hand goods;
2. Providing information on financial circumstances and personal affairs;
3. Agency of marriages, partnerships and acquaintances;
4. Operation of travel agencies and arrangement of accommodation;
5. Distribution and installation of building security equipment, including key services; and
6. Manufacture and distribution of special theft-related opening tools.

The business re-registration must be made in writing using the form provided. Receipt of the business registration shall be certified by the competent authority.

About the trade re-registration are also informed to other agencies (eg, tax office, the Chamber of Crafts or the Chamber of Commerce and Industry).

Maturity or approval of the guardianship court

The notification must be made when the business is relocated or the subject of the trade is changed.

When a trade requiring supervision is reregistered, the reliability of the trader is checked without delay. The applicant is therefore required to provide proof of reliability.
