Blackout Period; Requesting an Extension, Shortening, or Waiver

If you want to operate a restaurant, nightclub, etc., you must comply with the regulations regarding closing hours.

In Bavaria, the general closing time begins at 5 a.m. and ends at 6 a.m. (known as “cleaning time”). On the night of January 1, the closing time is suspended.

If there is a public need or special local circumstances, closing hours may be extended (i.e., the establishment in question must close earlier than 5 a.m.), shortened, or suspended by municipal ordinance. Under the same conditions, municipalities may also extend or completely lift the closing time for individual establishments on a case-by-case basis.

The closing time regulation has been in effect in this form since January 1, 2005.

Municipalities may deviate from the general closing time only if this is justified by a public need or special local circumstances.
When deciding which curfew hours to set, municipalities must in all cases take into account the interests of the neighborhood—in particular, its right to an undisturbed night’s rest.

The fees are determined in accordance with the Cost Act in conjunction with the Schedule of Fees.
