Temporary structures; notification of erection and acceptance of use

Temporary structures are structures that are suitable and intended to be repeatedly erected and dismantled at different locations. Temporary structures include, for example, grandstands, stages with or without canopies, advertising towers, tents of all kinds, air structures, rides (from swing boats to Ferris wheels), amusement rides, amusement and sales stores, catering facilities, etc. Construction site facilities and installations in amusement parks are not temporary structures.
The building supervisory authority must be notified at least one week in advance of the intended erection of temporary structures requiring approval, together with the inspection log book, unless this is not required under the construction permit.
Temporary structures requiring approval may only be put into operation if
- they have been accepted by the building supervisory authority (acceptance for use), unless this is not required under the construction permit or the building supervisory authority waives this requirement in individual cases, and
- the inspections prescribed in the building permit have been carried out by experts in accordance with Art. 72 Para. 2 Sentence 3 of the Bavarian Building Code (BayBO).
Temporary structures requiring a permit may only be erected and put into use if a building permit has been issued before they are erected or put into use for the first time.
Construction permits issued by other states of the Federal Republic of Germany are also valid in the Free State of Bavaria.
Temporary structures requiring approval must be reported to the building supervisory authority.
Temporary structures are exempt from notification if this is specifically noted in the inspection logbook or if a building permit is not required, i.e:
- temporary structures up to 5 m in height that are not intended to be entered by visitors,
- flying constructions with a height of up to 5 m that are operated for children and have a maximum speed of 1 m/s,
- stages that are temporary structures, including canopies and other structures with a height of up to 5 m, a floor area of up to 100m2 and a floor height of up to 1.50 m,
- ground-floor tents and walk-in sales stands that are temporary structures, each with a floor area of up to 75m2,
- inflatable play equipment with a height of the accessible area of up to 5 m or with covered areas where the distance to the exit is no more than 3 m or, if the roofing is structurally prevented from sinking, no more than 10 m,
- restroom trailers.
