Travel Industry; Notification of an Activity Not Requiring a License

If you wish to sell or purchase goods on a commercial basis without a prior order, outside of a commercial establishment or without operating such an establishment; offer services; solicit orders for services; or operate as a traveling showman, you generally need a permit (travel trade license) (for more information, see “Related Topics” – “Travel Trade; Permit”).

However, certain activities are exempt from the requirement for a traveling trade license (see “Related Topics” – “Occasional Sale of Goods; Applying for a Permit”). Some of these activities, however, are subject to a notification requirement with the municipality, provided the business is not already subject to a business registration requirement. These include:

• the sale of goods, the purchase of goods, the offering of services, or the solicitation of orders for services within the municipality of one’s residence or business location, provided that the municipality has no more than 10,000 residents,
• the sale of food or other everyday goods from a non-fixed sales location or another facility at regular, short intervals at the same location,
• the sale of printed materials on public roads, streets, squares, or other public places.

In this regard, you must file a business registration with the competent municipality. Local jurisdiction lies with the municipality in whose district you have your habitual residence.

• Legal age or authorization from the legal representative(s), as well as approval from the family court

The report must be filed with the appropriate municipality.

The notification must be filed before commercial operations begin.

• Valid ID card or passport
• Business Listing
• Legal entities: Extract from the commercial register or comparable registration documents from abroad (with a German translation)
• GmbH in the process of being formed: a copy of the notarized articles of incorporation and a power of attorney from the founders stating that business operations are to commence before the GmbH is entered in the commercial register
• Minors: Authorization from the legal guardian(s) and approval from the family court
• Power of Attorney: Written power of attorney and identification documents for both the principal and the agent
