Wastewater disposal; payment of a small-scale discharger fee
Under the Federal Wastewater Discharge Fee Act and the Bavarian Water Act (BayWG), municipalities are required to pay a wastewater discharge fee to the state on behalf of small dischargers.

For the 2025 tax year, the BayAbwAG and the VwVBayAbwAG apply in the versions valid through December 31, 2025. For this reason, the forms will continue to be made available.

The small-scale discharger fee (sewage fee) is payable by the municipality for small-scale discharges of domestic wastewater up to 8 m³/d in cases of direct discharge into a body of water or infiltration, if the wastewater is discharged into a body of water without being treated at a wastewater treatment plant or if the sewage sludge is not properly disposed of. The fee can generally be passed on to the polluter.
Under the Federal Wastewater Discharge Fee Act and the Bavarian Water Act (BayWG), municipalities are required to pay a wastewater discharge fee to the state on behalf of small dischargers. Small dischargers are defined as households that discharge or allow less than 8 m³ of wastewater per day to seep into a body of water. The law grants municipalities subject to the levy the option to pass the wastewater levy on to property owners.
The fee is determined by an official notice.
Small discharges are exempt from the fee if the discharge has been treated in a small wastewater treatment plant constructed in accordance with generally accepted technical standards and the proper disposal of the sewage sludge is ensured.
