Housing Restrictions for Subsidized Housing; Applying for Release from Occupancy Restrictions

Social housing is subject to occupancy restrictions. This imposes an obligation on the person authorized to dispose of the property to rent out the subsidized housing only to individuals who meet certain requirements.

In special cases, there may be sufficient grounds to release the subsidized housing (a single apartment or multiple apartments) from all occupancy restrictions and instead establish equivalent restrictions on other housing owned by the authorized party. To do so, an application for release from the occupancy restrictions must be submitted. Unlike an exemption, the release from these restrictions is permanent.

The competent authority may release the authorized user from the occupancy obligations if

• this serves to create or maintain socially stable resident structures or is required for other compelling public interests, and
• the person with the right of disposal enters into commitments regarding other housing of equal total value for the period beginning upon release from the commitments.
