The 2021 State Treaty on Gambling pursues, among other things, the following objectives:
- Preventing and combating gambling addiction,
- Preventing the emergence of a black market for gambling,
- channeling the urge to gamble into orderly and supervised channels,
- Protection of minors and players,
- preventing fraud,
- and safeguarding the integrity of sports competitions when organizing and facilitating sports betting.
To better achieve these objectives, the State Treaty prohibits the organization and brokering of public gambling without a license.
Advertising for licensed gambling is permitted in compliance with the requirements of Section 5 of the GlüStV 2021; however, the nature and scope of advertising for public gambling must not conflict with the objectives of the State Treaty on Gambling, and the advertising must not be excessive. Advertising for unauthorized gambling is prohibited.
The gambling supervisory authorities are tasked with monitoring compliance with the public law obligations associated with the 2021 State Treaty on Gambling and with ensuring that the operation or facilitation of unauthorized gambling and advertising for such activities are prevented. To this end, they may issue the necessary orders on a case-by-case basis within the scope of their jurisdiction.
Competent Authorities
The competent gambling supervisory authorities in Bavaria are the municipalities, the district offices, the regional administrations, and the State Ministry of the Interior, Sports, and Integration, acting as security authorities.
The Joint Gaming Authority of the Federal States ( GGL) is responsible for gaming supervision regarding unauthorized public gambling and advertising thereof that is offered on the Internet in more than one federal state.
