The Ordinance on Places of Assembly provides for the possibility of temporarily using rooms that are not actually intended and approved for this purpose to hold events.

If events with more than 200 visitors are to be held in rooms that are not approved as places of assembly and do not comply with the provisions of the Ordinance on Places of Assembly, the lower building supervisory authority must be notified.

Notification is not required if the rooms have already been approved as a place of assembly and the approval includes the type of event.

The temporary use of rooms for an event with more than 200 visitors must be reported if

• the rooms do not comply with the provisions of the Ordinance on Places of Assembly and
• a building permit as an assembly room, which includes the type of event intended, is not available.

The notification with any necessary documents must be submitted to the responsible lower building supervisory authority.

As part of the notification procedure, the building supervisory authority checks whether the event can be held as planned. It confirms receipt of the notification to the operator or organizer and informs them whether it intends to take safety measures.

There is no general, Bavaria-wide deadline for this type of notification. However, this should be agreed in good time in advance with the local building supervisory authority.
