Access Permit; Application

Pursuant to Section 11(8) of the Residence Act (AufenthG), a foreign national subject to an entry and residence ban may, in exceptional cases, be permitted to enter the federal territory for a short period if compelling reasons require his or her presence or if denying the permission would result in undue hardship. 

The right to enter for a short period under Section 11(8) of the Residence Actdoesnotincludea right to freedom of movement; the entry permit merely ensures that you can actually fulfill the compelling reasons that require your presence in the federal territory. 

The entry permit is neither a Schengen visa nor a residence permit; it merely exempts you from the entry ban resulting from an expulsion or deportation. Thus, a granted entry permit does not replace a required visa or residence permit.

Permission to enter the country is granted on an exceptional basis and only for a short-term stay.

Before the entry and residence ban expires, a foreign national who has been expelled or deported may be permitted to enter the federal territory for a short period only if

• compelling reasons necessitate his or her presence, or
• denying the permit would result in exceptional hardship.

You must apply to the competent authority for a residence permit.

As a general rule, the Foreigners’ Registration Office in the district where you intend to stay is responsible for issuing an entry permit.

If the entry and residence ban resulted from a deportation or refoulement order issued by the Federal Police or another border control authority, that authority is responsible for deciding on the entry permit. 

If a foreign national has been expelled from the federal territory due to a crime against peace, a war crime, or a crime against humanity, or on the basis of a deportation order pursuant to Section 58a of the Residence Act (AufenthG), the highest state authority is responsible for deciding on the entry permit.
