Important:
Plan your move carefully and contact your caseworker in good time!
Questions and answers
Before signing a new tenancy agreement, you must obtain the Jobcenter's assurance that the monthly rental costs will be recognized. The Jobcenter must guarantee to pay the current accommodation costs if they are reasonable, § 22 Para. 4 SGB II. Appropriateness is assessed on the basis of the applicable upper rent limits.
The rental agreement is valid even without the Jobcenter's assurance. You should therefore only sign the tenancy agreement once you have received confirmation from the Jobcenter that the rent is acceptable. Even without confirmation, you are bound by the rental agreement and must pay the rent. It can have negative financial consequences if a rental agreement is signed or a move is carried out without the assurance of the individual Jobcenter.
You must move in such a way that you do not have to pay two rents at the same time. Be sure to observe the notice period of your current tenancy agreement.
A move may be necessary for various reasons, for example due to
- taking up employment or training
- Reduction in accommodation costs, as the current rent exceeds the upper rent limit
- Family reasons, e.g. due to a new addition to the family, separation, need to care for relatives
- A young adult moves out
- health restrictions or disability
- imminent eviction from the apartment, e.g. notice of termination/eviction by the landlord
Other reasons are possible. In this case, you must give good reasons for your wish to move.
The Jobcenter must guarantee to cover the accommodation costs for people who have not yet reached the age of 25 when they want to move out of their parents' home for the first time if
- the persons cannot remain in their parents' home for serious social reasons (e.g. serious conflicts, expulsion, your parents refuse to continue to support you materially or immaterially)
- the move is necessary in order to take up gainful employment (e.g. training, work)
- there is a similarly serious reason (e.g. pregnancy, starting a family with a partner, overcrowding in the parents' home, separation of the parents and dissolution of the community of need)
If the assurance is not obtained, no accommodation costs, heating costs or relocation costs will be covered until the age of 25 and no rent deposit loan will be granted.
If you move from Erlangen to another city or municipality, its criteria for appropriateness apply. Only the locally responsible Jobcenter can issue an assurance for the new rent.
Please submit the following documents for verification of the confirmation:
- Form to confirm the move
- Concrete and fully completed but unsigned rental offer (minimum contents: new address, landlord's details, apartment size in square meters, number of people moving in, rent broken down into basic rent, cold ancillary costs and heating costs and as total rent, other costs and their monthly amount, energy status)
- Proof of necessity (employment contract, notice of termination, judgment)
Higher ongoing rental costs for the new apartment cannot be taken into account. The Jobcenter will pay the rent even if it has not been approved, provided it is reasonable. If the rent is unreasonable, the maximum that will be recognized is what was recognized before the move. If the move is not necessary, the maximum that will be recognized is what was recognized before the move.
