In Bavaria, waste disposal is the responsibility of the districts and independent municipalities. For waste from private households, among other things, there is a basic obligation to use municipal facilities. In order to carry out their duties effectively, the public authorities can join together to form special-purpose associations or commission a private third party, including a limited liability company (GmbH) supported by the public authority, to actually carry out the waste disposal.

The public authorities regularly refinance themselves through waste disposal fees. In addition to ongoing operating costs, these also include the annual depreciation on investment costs and provisions for future renovation costs.

When calculating the fees, the public authorities have a certain amount of leeway as to the extent to which they charge uniform fee rates or separate fee rates for different services (e.g. organic waste garbage cans, bulky waste disposal). The relevant user and fee statutes of the respective facility providers are decisive.
