Fees are charged for the disposal of waste. The person liable for the fee is the person who uses the waste disposal facilities of the district or the independent city.

In Bavaria, waste disposal is the responsibility of the districts and independent municipalities. For waste from private households, among other things, there is a basic obligation to use municipal facilities. In order to carry out their duties effectively, the public authorities can join together to form special-purpose associations or commission a private third party, including a limited liability company (GmbH) supported by the public authority, to actually carry out the waste disposal.
The public authorities regularly refinance themselves through waste disposal fees. In addition to ongoing operating costs, these also include the annual depreciation on investment costs and provisions for future renovation costs.
When calculating the fees, the public authorities have a certain amount of leeway as to the extent to which they charge uniform fee rates or separate fee rates for different services (e.g. organic waste garbage cans, bulky waste disposal). The relevant user and fee statutes of the respective facility provider are decisive.

The fees are charged by means of a fee notice.
The fees are levied by means of a fee notice, against which an appeal and/or action for annulment is permitted. Once the notices have become final, corrections are regularly at the discretion of the responsible bodies.
The amount of the waste fees is determined by statute.
