Rental Restrictions on Subsidized Housing; Applying for Permission for Owner-Occupancy, Leaving the Property Vacant, and Other Uses

If you wish to use subsidized housing for your own purposes, leave it vacant and unrented for more than three months, or use it for purposes other than residential ones, you must obtain a permit. You can apply for this permit informally at the appropriate authority (district offices, independent cities, large district capitals, or “large delegated municipalities”).

Permission for personal use will be granted if you meet the income limits required for obtaining a housing eligibility certificate.

Leaving the apartment vacant for a period longer than three months is permitted if it is not possible to rent it out and the purpose of the subsidy cannot be fulfilled in any other way.

Permission to use the living space for purposes other than residential use may be granted only if there is an overriding legitimate public or private interest; the competent authority shall decide in this matter at its discretion. In doing so, it may require reasonable financial compensation or the establishment of obligations regarding other housing of equal total value.
