Traveling Camp; Advertisement

A traveling sales operation exists when a business operator, outside of a commercial establishment and outside of a trade show, exhibition, or market, temporarily offers goods or services for sale from a fixed sales location or solicits orders for goods or services.

The organization of a traveling sales operation must be reported to the authority responsible for the location of the event four weeks before it begins if

• the event is to be publicized through public announcements and
• the arrival and departure of participants to and from the location of the traveling sales event is to be provided by transportation services offered on a commercial basis by the organizer or by persons acting in cooperation with the organizer.

The public announcement must contain the following information:

• the type of goods or services to be sold as part of the traveling fair,
• the location of the traveling sales event,
• the name of the organizer, the address where the organizer is established, and contact details that enable quick contact and direct communication with the organizer, including a phone number and an email address, and
• information, presented in a clearly recognizable and legible form or otherwise easily noticeable, regarding the conditions under which the consumer is entitled to a right of withdrawal for contracts concluded as part of the traveling fair.

Furthermore, the public announcement must not include any free giveaways (goods or services), including contests, raffles, and sweepstakes.

The traveling fair may be managed on site only by the organizer named in the notice or by a representative authorized in writing by the organizer; the representative’s name must be provided to the authorities in the notice.

Regardless of the traveling fair notice, a traveling trade license is required.

The notice must include:

• the location, date, and time of the traveling sale,
• the name of the organizer and the name of the party on whose behalf the goods or services are being sold, including the address at which these parties are established; for legal entities, additionally the legal form and the authorized representatives,
• information enabling quick contact and direct communication with the organizer, including a phone number and an email address,
• the name of the commercial register, association register, or cooperative register in which the organizer is registered, and the corresponding registration number,
• the wording and form of the intended public announcement, and
• the name of a representative of the organizer of the hiking camp named in the notice, who has been authorized in writing to manage the camp on site on behalf of the organizer.

For non-EU citizens, a residence permit that allows for the pursuit of self-employment is generally required.

The notice must be given no later than four weeks before the event begins.

• Valid ID card or passport
• For non-EU citizens: a residence permit that allows for self-employment
• For registered companies: an extract from the commercial register or comparable registration documents from abroad (with a German translation)
• For civil law partnerships: partnership agreement
• If an authorized representative is present: a written power of attorney and identification documents for both the principal and the authorized representative
