You can apply for a partial excavation permit if you have submitted an excavation application but have not yet received an excavation permit. This allows you to obtain approval in advance for individual parts of the project.

Apply for a partial building permit online
You can use this online application to apply for a partial building permit.
Convenient and digital: Simply fill out this online application directly in your web browser. In many cases, this saves you a trip to the government office.
You may not begin excavation work until the excavation permit has been issued. This can take longer, especially for larger projects. With a partial excavation permit, you may begin work on individual sections of the project in advance. However, this applies only to the section for which you have received the partial excavation permit.
The portion of your project already covered by the partial excavation permit will not be subject to further review as part of the excavation permit process.
You must first apply for an excavation permit. Only then can you apply for a partial excavation permit for part of the project.
The requested partial excavation permit will be granted only if the project is subject to approval. Furthermore, no public law regulations may preclude the part of the project for which the partial excavation permit is being requested. In addition, the lower-level excavation authority must determine that the overall excavation project is, in principle, permissible. The granting of the partial excavation permit is at the discretion of the lower-level excavation authority.
Written Submission
- After submitting your excavation application, submit the partial excavation application in writing, along with the required documents, to the local excavation authority (district offices, independent cities) in whose jurisdiction the excavation site is located.
- No specific form is required.
- The application must be submitted in writing; verbal applications are not permitted.
- The local excavation authority reviews the application and makes a decision on it.
Digital Submission
Digital submission of applications for partial excavation permits is not yet possible throughout all of Bavaria. When you select a location, the link to the online procedure will appear, provided it is already available.
- The application for a partial excavation permit can be submitted digitally to the lower-level excavation authority using the online wizard.
- The excavation plan is uploaded to the online wizard in electronic form (PDF files). Signatures are replaced by authentication via a “BayernID” or “Mein Unternehmenskonto” user account.
A partial excavation permit may be particularly useful if you want to begin excavation work soon but it is foreseeable that the process of obtaining the full excavation permit will take longer. A granted excavation permit also includes a determination that the overall project is, in principle, eligible for approval. In some cases, however, you may not receive the requested excavation permit at a later date.
The partial excavation permit must be applied for before the excavation permit is issued.
The processing time depends on the scope and complexity of the application, the number of agencies involved, and the agency's current workload.

The fees for a partial excavation permit depend on the volume of usable excavated material:
- For sand and gravel pits, quarries, and similar excavation sites for the extraction of excavated material for projects with up to 50,000 m³ of usable excavated material: 100 EUR plus 25 EUR for each 1,000 m³ or fraction thereof
- For sand and gravel pits, quarries, and similar excavation sites for the extraction of excavated material for projects with usable excavated material exceeding 50,000 m³ up to 500,000 m³: 1.350 EUR plus 55 EUR for each 10,000 m³ or part thereof exceeding 50,000 m³
- For sand and gravel pits, quarries, and similar excavation sites for the extraction of excavated material for projects with usable excavated material exceeding 500,000 m³ 3.825 EUR plus 110 EUR for each 50,000 m³ or more exceeding 500,000 m³
- For other independent excavation projects: 50 to 2,000 EUR
If an environmental impact assessment is required, the fee increases by 40%. The fee will be offset against the subsequent excavation permit fee.
Plan assumption
This is where all incoming applications are received, recorded and checked for completeness. Building applications that have significant deficiencies and therefore cannot be processed are returned to the applicant.
