Construction Project; Application for a Partial Building Permit

You may not begin work on your construction project until the building permit has been issued. This can take longer, especially for larger projects. With a partial building permit, you can begin work on individual sections of the construction project in advance. However, this applies only to the section for which you have received the partial building permit.

The portion of your construction project already covered by the partial building permit will no longer be subject to a decision as part of the building permit process.

You must first submit a building permit application. Only then can you apply for a partial building permit for part of the project.

The requested partial building permit will be granted only if the project is subject to approval. Furthermore, no public law regulations may preclude that part of the project, and the lower building authority must determine that the overall construction project is, in principle, permissible. The granting of the partial building permit is at the discretion of the lower building authority.

Written Submission

Please note first of all that for building permit applications involving the construction or alteration of buildings, the construction documents must be prepared by a design professional authorized to submit such documents (architect, civil engineer; for smaller construction projects, particularly single-family and two-family homes, master craftsmen in the fields of construction and carpentry, as well as state-certified technicians specializing in construction engineering). This also applies to the construction documents for applications for partial building permits.

• After submitting your building permit application, submit the application for a partial building permit in writing, along with the required documents, to the lower building supervisory authority (district offices, independent cities, major district cities, and certain larger municipalities) in whose jurisdiction the building lot is located.
• No specific form is required. Oral applications are not permitted.
• The application must be signed by the building owner and the designer authorized to submit the building plans.
• The lower building authority reviews the application and decides on it.
• Before making a decision, the lower building authority must consult the agencies whose involvement or consultation is required by law for the decision on the building application, or without whose opinion the eligibility of the building application for approval cannot be assessed (for example, the lower environmental protection authority, the lower water rights authority, or the road traffic authority). However, this applies only if these agencies have not already commented on the overall building application. Municipal approval must be obtained prior to the issuance of the partial building permit, provided that it is required under building planning law.

Digital Submission

Digital submission of applications for partial building permits is not yet possible throughout all of Bavaria. When a location is selected, the link to the online procedure will appear, provided it is already available.

• The application for a partial building permit can be submitted digitally to the lower building authority using the online wizard.
• The construction documents are uploaded to the online wizard in electronic form (PDF files). The signatures of the building owner and the design author authorized to submit construction documents are replaced by authentication via a “BayernID” or “Mein Unternehmenskonto” user account.
• For applications for a partial building permit where the construction documents must be prepared by a designer authorized to submit construction documents, that designer must authenticate themselves and submit the application on behalf of the building owner.

A partial building permit can be particularly useful for excavating a foundation pit, laying the foundations, and constructing the basement. A granted partial building permit also includes a determination that the overall project is, in principle, eligible for approval. In some cases, however, you may still not receive the building permit you applied for at a later date.

The fees for a partial building permit range from 1 per thousand to 4 per thousand of the construction costs, depending on the type of construction project and the type of permitting process. The fee will be offset against the subsequent building permit fee.
