Construction Projects; Online Submission of the Criteria Checklist

The list of criteria includes various points relevant to assessing the structural stability of the planned project. For certain projects, the structural engineer may declare that all points listed in the criteria catalog have been met. In such cases, the otherwise required certification of the structural stability analysis by a structural stability expert, or the review of structural stability by the local building authority, a reviewing engineer, or a review office, is not necessary. However, the declaration of compliance with the list of criteria must be submitted.

Submitting the declaration of compliance with the criteria catalog is not a standalone procedure but must always be done in conjunction with other procedures. Depending on the specific construction project, it must be submitted either as part of the construction application or as an attachment to the notice of commencement of construction.

However, when submitted alongside digitally filed building applications and notices of commencement of construction, it can be submitted directly online by the structural engineer.

If all criteria in the criteria catalog are met for buildings in building classes 1 through 3, as well as for tanks, bridges, retaining walls, grandstands, and other structures with a clear height of more than 10 meters that are not buildings, the requirement for certification of the structural stability analysis by a structural stability expert or for the structural stability review by the local building authority, an inspection engineer, or an inspection agency is waived.

However, a declaration of compliance with the criteria catalog, issued by a qualified structural engineer—usually the person who prepared the structural stability analysis—must be submitted.

If the construction project is a special-purpose structure, the declaration must be submitted along with the building permit application. Otherwise, submission with the notice of commencement of construction is sufficient.

Notwithstanding the above, however, submission of the declaration is not required in the case of residential buildings in building classes 1 and 2 or above-ground single-story buildings with clear spans of no more than 12 m and a floor area of no more than 1,600 m², which are not intended for habitation or are intended only for the temporary occupancy of individual persons.

Digital Submission

Digital submission of the declaration of compliance with the criteria catalog is not yet possible throughout all of Bavaria. When you select a location, the link to the online procedure will appear, provided it is already available.

• The structural engineer who prepared the structural stability analysis can submit the declaration of compliance with the criteria catalog digitally using the online wizard.
• The standard form “Declaration of Compliance with the Criteria Catalog” is replaced by the prompts in the online wizard.
• The signature is replaced by authentication via a “BayernID” or “Mein Unternehmenskonto” user account.

To enable the lower-level building authority to link the submission to the digital building permit application or the digital notice of commencement of construction, the case number must be provided—this number was communicated to the submitter upon submission of the digital building permit application or the digital notice of commencement of construction.

The declaration of compliance with the list of criteria is not a separate application; depending on the project, it must be submitted either with the building permit application or with the notice of commencement of construction.

There are no separate costs associated with submitting the declaration regarding the list of criteria.
