Construction Projects; Notification of the Start of Construction

Notifying the authorities of the start of construction is not the same as submitting an application. You simply need to inform the lower-level building authority of the upcoming start of construction.

The purpose of notifying the local building authority of the start of construction is to ensure that the authority has sufficient time to prepare for construction supervision and to verify whether the building permit has expired.

Consequences of Failure to Notify

If you intentionally or negligently fail to notify the lower building authority of the start of construction at least one week before construction begins, you are committing an administrative offense. You may be subject to a fine of up to 500,000 EUR. In addition, the lower building supervisory authority may order a halt to construction.

You must notify the authorities of the start of construction if:

• You begin work on a construction project that requires a permit,
• you resume construction work after an interruption of more than 6 months, or
• you are removing a structure that is subject to notification.

This also applies to projects covered by a partial building permit as well as to projects that are exempt from requiring a permit.

Written Submission

• Submit the completed and signed “Notice of Commencement of Construction” form, along with the required attachments, to the lower building authority (district offices, independent cities, major county seats, and certain larger municipalities).
• A verbal notification is not sufficient.
• You will not receive an acknowledgment of receipt.
• The lower-level building authority will then verify whether the building permit is still valid. It may also take steps to oversee the construction, if necessary.

Digital Submission

Digital submission of notices of the start of construction is not yet possible throughout all of Bavaria. When you select a location, the link to the online procedure will appear, provided it is already available.

• The start of construction can be reported digitally to the lower-level building authority using the online wizard.
• The standard forms “Notice of Commencement of Construction” and (if required) “Designation of the Responsible Structural Engineer for Construction” are replaced by the prompts in the online wizard.
• Signatures are replaced by authentication via the “BayernID” or “Mein Unternehmenskonto” user account.
• The remaining attachments are uploaded in electronic form (PDF files) via the online wizard.

You must give notice of the start of construction at least one week before work begins.
