Construction Project; Notice of Commencement of Use

The notice of commencement of use is not an application. You are simply required to inform the lower building authority of the upcoming commencement of use.

The purpose of the notice of commencement of use is to ensure that the lower-level building authority has sufficient time to verify that the conditions for occupancy are met, if necessary.

Consequences of Failure to Notify

If you fail to notify the lower building authority of the commencement of use at least two weeks in advance, whether intentionally or through negligence, you are committing an administrative offense. You may be subject to a fine of up to 500,000 EUR.

You must report the commencement of use of a structure if it was constructed based on a building permit or was exempt from requiring a permit. This also applies if the building permit or exemption from the permit requirement merely involved a change of use, or if the building permit is deemed to have been granted due to the application of the deemed approval provision.

You are not required to report the commencement of use for projects that do not require a permit or for projects that do not require a building permit due to the priority of other authorization procedures.

Written Submission

• Submit the completed and signed “Notice of Commencement of Use” form, along with the required attachments, to the lower building authority (district offices, independent cities, major county seats, and certain larger municipalities).
• A verbal notification is not sufficient.
• You will not receive an acknowledgment of receipt.
• The lower-level building authority will then review, if necessary, whether the conditions for occupancy have been met.

Digital Submission

Digital submission of the Notice of Commencement of Use is not yet possible throughout all of Bavaria. When you select a location, the link to the online procedure will appear, provided it is already available.

• The commencement of use can be reported digitally to the lower building authority using the online wizard.
• The standard “Notice of Commencement of Use” form is replaced by the prompts in the online wizard.
• Signatures are replaced by authentication via a “BayernID” or “Mein Unternehmenskonto” user account.
• Attachments are uploaded in electronic form (PDF files) via the online wizard.

• If applicable, Fire Safety Certificate II (see "Forms" for the form)
  Required only for special structures, medium- and large-scale parking garages, and buildings in Building Class 5, unless the fire safety certification is reviewed by the building authority.
• Fire safety certification, if applicable
  Only if it has not been inspected by the building authority.
• if applicable, confirmation by an authorized certifier that the construction work complies with the fire safety certification
  Required only for buildings in Building Class 4, except for special-purpose structures and medium- and large-sized parking garages.
