Civil protection fund; application for reimbursement of operational costs for disaster management

Purpose

According to the Bavarian Civil Protection Act, fire departments and voluntary aid organizations, among others, are obliged to provide disaster relief. Grants are awarded from the Disaster Relief Fund to partially offset the operational costs of the disaster control authorities and those obliged to provide disaster relief in the event of disasters and thus prevent unreasonable burdens due to the obligation to provide disaster relief.

Object

A grant is awarded for expenses incurred as a result of measures to avert a hazard. The danger must have been caused by a disaster identified by the disaster control authority.

In accordance with the guidelines, grants are only awarded for expenses incurred by the disaster control authorities and those obliged to provide disaster relief, which were incurred as a result of measures to avert the dangers caused by a disaster (Art. 1 Para. 2 BayKSG) (deployment costs) and would not have been incurred without the disaster. The expenses attributable to measures to avert disasters must be verifiable and separable (calculable, definable).

Beneficiaries

Beneficiaries are local authorities, voluntary aid organizations and other institutions obliged to provide disaster relief.

Eligible costs

In terms of eligible costs, a distinction is made between own operational costs, external costs and special expenses.

Own operational costs include personnel and material expenses of the civil protection authorities and those obliged to provide disaster relief, such as

• continued benefits and compensation for loss of earnings (for operations directly related to disaster management),
• travel expenses,
• deployment allowances,
• Personnel costs (hours worked outside working hours or overtime that was paid separately),
• fuel costs,
• catering costs for emergency personnel/helpers,
• Repair and replacement costs for equipment damaged or lost during the disaster response (vehicles, equipment, material, protective equipment and uniforms).

External costs for the deployment of persons not obliged to provide disaster relief, e.g.

• fire departments of neighboring countries or states,
• Federal forces and facilities, in particular the Federal Agency for Technical Relief, the Federal Police and the Federal Armed Forces,
• stationed armed forces,
• private companies,
• private individuals.

Special expenses for other special measures in the context of the disaster operation, in particular for the care of the affected population (accommodation, care, food, medical care, etc.).

Type and amount

The funding is granted as pro rata financing/capital participation.

Grants are awarded as proportional financing in the form of non-repayable allocations. A personal contribution is deducted from the eligible costs if the disaster occurred in the applicant's own area of responsibility.

No. 5.2 of the guidelines stipulates separate own contribution amounts for own deployment costs, external costs and special expenses. The own contribution amounts to

• up to € 7,000 for municipalities belonging to a district,
• for counties, independent municipalities and districts up to € 30,000,
• up to €4,500 for other grant recipients.

The amount of the grant is generally 80% of the eligible costs after deduction of the personal contribution. In cases of hardship, the grant can be increased to up to 90%.

Notwithstanding this, the expenses of voluntary aid organizations for the reimbursement of continued services and compensation for loss of earnings are funded in full (after deduction of the personal contribution).

Grants are only paid out if the calculated subsidy exceeds €500. A grant will not be paid if the deployment costs are already offset by other funds.

Funding is provided without legal entitlement within the framework of the funds available in the disaster control fund.

Grants are only awarded for expenses that

• are in direct temporal and material connection with a disaster,
• were necessary to avoid danger or high material damage or
• are appropriate and efficient.

The costs of commissioning third parties who are not obliged to provide disaster relief will only be funded if they have been commissioned by the disaster control authority. Exceptions apply if:

• it was not possible for the disaster control authority to commission them due to imminent danger and
• equivalent relief forces or resources of the organizations obliged to provide disaster relief were not available or not available in time.

Exclusion criteria:

Expenses that are not related to the management of the disaster and expenses for repairing the damage caused by the disaster or for remedying the consequences are not eligible for funding. This includes, in particular, -the repair of structural damage to roads, bridges, bodies of water, buildings, etc. -costs of road cleaning, sewer cleaning, landfill fees and provision of containers, - disposal of contaminated material and sludge disposal, - repair of damage caused to private households and companies by the disaster and - personnel and material expenses of a general nature that would have been incurred even without the disaster.

Please note the following when using the form:

Applications from independent municipalities, counties and districts must be sent directly to the government in a single copy. Municipalities belonging to the district and other parties obliged to provide disaster relief submit their applications to their competent district administrative authority, which forwards the application to the government after reviewing it. The district administrative authority checks the applications submitted, including the attached factual report (as well as the attached supporting documents), in particular for completeness and conclusiveness and confirms the correctness of the application. The governments decide on the applications.

The application period is 6 month(s). Applications for grants to offset operational costs must be submitted within six months after the end of the disaster has been determined.

A processing time of 3 month(s) to 2 year(s) is to be expected.
