If your municipality has provided for this in its water supply ordinance, properties that are served by pipes from a public water supply system must, as a rule, also be connected to that system and use it. This obligation is referred to as the “mandatory connection and usage requirement.”
The authority to impose such an obligation on property owners for reasons of public welfare is governed by law in the Municipal Code (GO). Article 24(1)(2) of the Municipal Code (GO) permits municipalities to fulfill this duty through this means. This provision forms the basis for corresponding local regulations in municipal water supply ordinances mandating the connection and usage requirement.
Under certain conditions, however, property owners may also be fully or partially exempted from the obligation to connect to or use the system, or may be granted a restriction on the obligation to use it. The conditions for this are generally specified in more detail in the local water supply ordinance.
