Certain (smaller) construction projects may be carried out without a building permit and do not require an exemption procedure.
The building owner is responsible for ensuring that the project complies with these and all other public law regulations. For specific details, please contact your local municipality or the lower-level building inspection authority.

Effective January 1, 2025, amendments to the Bavarian Building Code—including Article 57—were introduced, providing procedural flexibility for the following projects:
- Attic conversions involving the construction of dormers
- Attic conversions without the construction of dormers
- Changes in use (please specify existing and new uses)
- Repair work
- Temporary cellular communication facilities
- Client, Phone Number, Email
You can submit this information informally to the building authority.

Art. 55 Principle
The exemption from approval under Articles 56 through 58, 72, and 73(1), third sentence; the limitation on building inspection under Articles 59, 60, 62a(2), Art. 62b(2), Art. 73(2), and Art. 73a, as well as the presumption of approval under Art. 68(2), do not exempt from the obligation to comply with the requirements imposed on facilities by publicregulations, and do not affect the building authority’s powers to intervene.

Art. 49 Basic Obligations
When constructing, modifying, changing the use of, or removing facilities, the building owner and, within the scope of their respective responsibilities, the other parties involved in the construction are responsible for ensuring compliance with public law regulations.

If the project is located in a single historic building, near a single historic building, or within a historic complex, it is mandatory to obtain a permit under historic preservation law in accordance with Art. 6 of the Bavarian Historic Preservation Act (BayDSchG) must be obtained before work begins (denkmalschutz@stadt.erlangen.de).
Please also note:
- Although there are no procedural requirements, the substantive legal provisions of the Bavarian Building Code must be strictly adhered to.
- The relevant planning documents and supporting evidence—in particular regarding fire safety, structural stability, compliance with the Building Energy Act (GEG), and, if applicable, the permit under monument protection law—must be kept on hand and presented upon request.
- Regardless of the freedom of procedure, you must independently assess whether an application for property drainage is necessary (grundstuecksentwaesserung@stadt.erlangen.de).
- We reserve the right to verify compliance with these requirements as part of building inspections.
- Failure to submit the required documentation may result in a halt to construction or a prohibition on use.
- We recommend that you inform your immediate neighbors about the planned construction project in order to avoid potential conflicts at an early stage.

These projects must be reported in writing to the Building Inspection Office 14 days before construction begins or the property is put into use.
