Occasional Passenger Transport by Passenger Car; Applying for a Permit for Excursions or Trips to Vacation Destinations

For sightseeing trips or trips to vacation destinations, you, as the business owner, determine the scope and destination of the trips in advance. The trips must end by returning to the point of departure. Passengers must have a ticket valid for the entire route, with the fare indicated on it. You may not carry passengers who wish to book only part of the route.

If you use a passenger car, you can obtain a permit for a maximum of five years. After that, you can apply for an extension.

• Personal and professional qualifications of both the applicant and the appointed managing directors
• A registered office or branch in Germany (as defined by commercial law)
• Evidence that the company is financially sound and capable of performing its duties

You must apply for the permit in writing to the appropriate authority. Depending on the service, you may be able to download an application form from the Internet.

You must provide the following information about the vehicles used:

• Number
• Type 
• Vehicle owner
• License plate numbers
• Manufacturer
• Vehicle Identification Number
• Number of Seats

After you have submitted the application with all required documents, the following entities, among others, may submit comments as part of the hearing process:

• the municipality
• the Chamber of Commerce and Industry
• the trade union
• the trade association

After the deadline for submitting comments has passed, the competent authority will make a final decision on the application and inform the applicant in writing of the outcome.

Note: If you wish to apply for an extension of the permit, you must submit a permit application along with the required documents to the appropriate authority well in advance of the expiration date of the current permit.

• The following documents are required for approval:
  
  • Certificate of Good Conduct (issued no more than three months prior to the date of application)
  • Extract from the Central Trade Register (not older than three months at the time of application)
  • Extract from the Central Traffic Register (not older than three months at the time of application)
  • Extract from the Commercial Register or Cooperative Register (as certified copies)
  • Copy of the articles of association and the list of shareholders
  • For legal entities: Proof of authority to represent the entity
  • Certificate of good standing from the tax office (not older than three months at the time of application)
  • Certificate regarding tax matters from the relevant municipality (not older than three months at the time of application)
  • Certificate of good standing from the Social Security Administration
  • You will need this certificate
    • from health insurance providers with which you currently insure or have previously insured employees, as well as
    • for yourself, if you are or were voluntarily or privately insured.
  • Certificate of Good Standing from the Occupational Safety and Health Association for Vehicle Operators (BgF)
  • Proof of professional competence
  • Certificate of equity capital and, if applicable, a supplementary certificate (the reference date for both must be no more than twelve months ago)
  • If you appoint other individuals to the management board, the following is required from them:
    • Certificate of Good Conduct (not older than three months at the time of application)
    • Extract from the Central Trade Register (not older than three months at the time of application)
    • Extract from the Central Traffic Register (not older than three months at the time of application)
    • Proof of professional qualifications
    • Proof of employment
  • Proof of the most recent general inspection of the vehicles in use
