Waste Management Activities - Application for a Permit Pursuant to Section 54 of the KrWG
You can fill out the form to apply for a permit for your waste management activities under Section 54 of the KrWG step by step electronically and then submit it to the competent authority. Supporting documents must be attached to the application. Please have these documents ready in the form of a PDF file with a maximum file size of 2 MB. Finally, the application must be signed with a qualified electronic signature. For this purpose, you can use, for example, the signature card and card reader used in the electronic waste tracking system.
Pursuant to Section 54(1) of the Circular Economy Act (KrWG), collectors, transporters, dealers, and brokers of hazardous waste must obtain a permit. The permit must be granted if the requirements are met.
Various legal provisions stipulate that no permit is required in certain circumstances. These circumstances and the underlying legal provisions are listed in Section 4.2 of Annex 2 to the Notification and Permit Ordinance (AbfAEV) - (Section 1 of the Regulation of December 5, 2013, Federal Law Gazette I, p. 4043) (see “Legal Basis”).
The permit is granted if the following requirements are met:
- The applicant (in the case of legal entities and associations of persons, those authorized by law, the articles of association, or the bylaws to represent or manage the business) and the persons responsible for managing and supervising the business must be trustworthy.
- The applicant, to the extent that he or she is responsible for managing the business, as well as the persons responsible for managing and supervising the business and all other personnel, must possess the professional and technical expertise necessary for their duties.
Submit the application along with the required documents to the appropriate authority.
The authority will send you a confirmation of receipt. After reviewing your application and documents, the authority may
- request additional documents or
- grant the permit with or without conditions, or
- deny the permit.

Only for applicants that are legal entities or associations of individuals - Personal Information from the Central Business Register (Document Type 9)
=> for individuals who are applicants or who legally represent a legal entity or association of persons acting as an applicant, as well as for the individuals designated by the applicant who are responsible for managing and supervising the business - Certificate of Good Conduct (Document Type OG)
=> for individuals who are applicants or who legally represent a legal entity or association of persons acting as an applicant, as well as for the individuals designated by the applicant who are responsible for managing and supervising the business - The applicant must request information from the Central Business Register and criminal background checks from the appropriate agency, which will then forward them to the licensing authority.
- Proof of professional competence in accordance with Section 5(1), first sentence, of the Notification and Permit Regulation (in particular, confirmation of participation in an officially recognized professional training course)
=> for the persons designated by the applicant who are responsible for managing and supervising the business; in this regard, the applicant may also designate himself or herself as such a person - Foreign credentials from another EU member state or from another signatory state to the Agreement on the European Economic Area
are equivalent to the German credentials listed above if the foreign credentials show that the applicant meets the eligibility requirements or requirements of the issuing country that are essentially comparable in terms of their purpose.
Fee for the decision on the permit application: 250 to 6,000 EUR
